復興航空公司昨（19）日傍晚董事會，通過針對資遣員工權益事項提案，同意遵照行政院勞動部及台北市政府勞動局來函解釋，依照「大量解僱勞工保護法」（大解法）作為員工資遣費的給付依據。也就是每位勞工資遣費一律以60天計，但是債權人是否接受仍有疑慮。

依台北市勞動局對大解法的解釋，給付員工資遣費將以大幅優於勞基法計算基準發放，不是原工作未滿一年加發10天、未滿3年加發20天，3年以上加發1個月資遣費的做法，而是一律改為發給60天資遣費，金額將比勞基法所定的多出2.6億餘新台幣。

復興航空自11月22日董事會決議公司進行解散至今，針對員工薪資及資遣費所信託的6億元專戶，已在勞動部及市府勞動局的指導下啟動，並按三梯次分批資遣。其中，第一批於12月2日資遣，其資遣費已於16日匯入薪資帳戶；第二批於12月12日資遣，資遣費也將於26日匯入。這項資遣費的作業時程都比勞基法所規範的30天更為提前，在離職日15天之內就完成發放。

不過因北市勞動局對大解法的解釋，將多出的2.6億資遣費，但因是行政令，債權人是否同意將其列入薪資，在清算時讓勞工可以優先取得仍有待觀察，如果債權人有異議並出訴訟，就需等候法院判決。
